This is a non-expert opinion, and state laws can vary as to their explicit meaning and application, but generally assault requires a legitimate injury or threat of injury. I would say it is certainly possible to be assaulted by a thrown cupcake or sandwich, but it might be a challenge to prove that you were rightfully in fear of harm, or whatever the statute might require. Especially beyond a reasonable doubt.
Harassment is a separate crime from assault, that could apply if it is a clear pattern with intent to intimidate or annoy.
In the other cases you mention, that definite sounds like a sexual assault charge.

i just want to say that i was in a situation where the defendant threw a sandwich on me. people look at this as something not serious, but it truly is. if a person is willing to pick up an object to hit you with it, it needs to be taken seriously, regardless if its food or even a pillow. if the intention is to harass, intimidate it’s a crime. i also would like to know what specific assault would you address the matter in when a person touched the victim sexual after making a sexual comment and after that open the shower curtain and watched the person in the shower naked and cursed at them. i called this sexual assault because of constant physical and verbal harassment from the offender to do harm.

I noticed the advertisement for the ones’ accused of assault and battery. Where are the people who help the victim??????????? My hip did not heal properly. My left wrist was stomped leaving scar tissue and loss of control. I had surgery for that earlier in 2010 the heavy steal toe boot did a good number on my hand and chest. Help for the defendants. That makes alot of sense just like the police officer that never checked on me the following day or took pictures. Local bar owner did this. Do you think that there were pay offs?

Dear Sir or Madam:
About the same time I was kicked in my head 5 times. I had a head concussion; I was laid up 2 months with headaches and nausea. Some memories came back after 2 months. The court of Pendleton County, Ky
has not charged accordingly to the crime. I had 3 surgeries earlier in the year and just 4 months prior a full hip replacement. The woman who assaulted me was a repeated offender for assaults and DUI’s. To this day over 6 months she has not been held accountable.
The officer who took report did not write an accurate description of what happened. This woman has been getting away with this for years. The county attorny won’t talk to me. I have hospital statements and testing to show she also herniated a disc in my neck. I have already had surgery twice on my neck. I was left unconsicous along the road side. The legal aide said victims dont have rights to talk with prosecutor. Who is going to make this woman accountable? My whole body was stomped, bruises appeared quickly. The police came another time when one of the parties approached my home 2:oo am and the officer did not go search for the once again drunk criminal. Where do I turn?
